1. About these terms
These terms apply to consumer orders placed through the Orchestra Books website. Separate written terms may apply to trade, institutional, distribution, rights, bespoke or bulk orders. Nothing in these terms limits rights that cannot lawfully be excluded.
2. The website
You may use the website for lawful purposes. You must not attempt to interfere with its security, misuse another person’s account, introduce malicious code, scrape the website in a way that disrupts the service, or use content in breach of intellectual-property rights.
3. Product information
We take reasonable care with titles, authors, ISBNs, formats, dimensions, publication dates, cover images and descriptions. Editions may differ slightly from photographs or bibliographic information, especially for imported, reprinted, antiquarian or previously published books. Please contact us before ordering if a particular edition or physical characteristic is essential.
4. Prices and payment
Prices are shown in the currency displayed at checkout and include applicable taxes where stated. Delivery charges are shown before the order is submitted. Payment must be authorised by the payment provider. We may correct an obvious pricing error before accepting or dispatching an order and will contact you where necessary.
5. How the contract is formed
Placing an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. The contract is formed when we send an order confirmation or dispatch confirmation that clearly accepts the order. We may refuse or cancel an order before acceptance, for example because of stock, payment, delivery restrictions, suspected fraud or an obvious error, and will refund sums paid for the cancelled item.
6. Availability and substitutions
All orders are subject to availability. We will not substitute a materially different edition or format without your agreement. Where only part of an order is unavailable, we may offer to dispatch the remaining books and refund the unavailable item.
7. Delivery
Estimated dispatch and delivery times are not guaranteed unless we expressly agree a fixed date. We will deliver within the period agreed with you and, for consumer orders, within the legally required period unless another period has been agreed. Risk passes when the goods are delivered to you or a person identified by you. Please see our Shipping & Delivery page.
8. International orders
Customers outside the United Kingdom are responsible for checking local import restrictions. Import VAT, customs duty, clearance charges or local taxes may be payable to the carrier or authorities and are not included unless checkout expressly says otherwise.
9. Cancellation, returns and refunds
Consumers purchasing at a distance may have a statutory right to cancel most orders. Faulty or misdescribed goods are covered by separate statutory rights. The procedure, time limits, exceptions and return-cost information are set out in our Returns & Cancellations Policy.
10. Your responsibility for returned goods
You may inspect a book as you would in a shop, but you are responsible for diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the item. Please pack returns securely.
11. Our liability
We do not exclude or limit liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights. Subject to that, we are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses arising from a consumer purchase.
12. Events beyond reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, customs delay, industrial action, natural events, war, public-health restrictions, cyber incidents affecting third parties, or interruption of essential services. We will take reasonable steps to minimise the effect and keep you informed.
13. Intellectual property
The website’s design, text, branding and original content are protected by intellectual-property law. Book covers, extracts and publisher materials may belong to their respective rights holders. See Copyright & Permissions.
14. Personal information
We process personal information as described in our Privacy Policy.
15. Complaints
Contact us using the procedure on our Complaints page. We will try to resolve issues fairly and promptly.
16. Governing law
These terms are governed by the law of England and Wales. A consumer resident elsewhere in the United Kingdom or another country may also benefit from mandatory protections and may be entitled to bring proceedings in the courts available under applicable consumer law.
